从法学的角度，在对相关概念界定的基础上，分析了我国学校体育伤害事故诉讼中学校抗辩的现状，引入甘冒风险、共同过失等作为体育伤害侵权的抗辩事由，针对学校是否承担责任以及责任大小的诉讼进行抗辩，从而切实维护好学校、教师和广大学生的合法权益。

英文摘要:

From the viewpoint of law and on the basis of defining the relative concepts, the paper discusses the status quo of school defence in the lawsuit of school sports injuries in China. It introduces the defensive causes of risk taking and joint negligence, which can be used in lawsuit for determining school's liability, in order to protect the legal rights of schools, teachers and students.
